Who is eligible?
There are two main factors that determine whether you are eligible for legal aid and that is the type of case and your financial circumstances. Therefore, before we can take on your case we will need to assess you on the following to make sure you qualify for legal aid.
You will need to provide confirmation of your support and accommodation in the UK. This could be any of the below;
- A letter from NASS confirming that you are in receipt of either s95/ s4 support, a copy of your ARC card and any receipts for payments taken for NASS, ideally dated within a month of the referral.
- A letter from a friend or family member confirming the nature and extent of support provided. Where this is the case we will also require a copy of this person’s ID, three months bank statements and three months payslips.
- Confirmation of income support/ universal credit/ any benefits received.
We understand that not all situations and cases are as straight forward and in such cases we can apply for ECF (Exceptional Case Funding).
